It also describes how Mexx maintains, uses, and discloses personal information. This Privacy Policy applies to information collected from you by Mexx via this website www.mexx.ca/en and various subdomains (collectively, the "Sites"); our retail stores (the “Stores”); and other places where we may collect personal information. This Privacy Policy also sets out how you can access certain information that Mexx may collect about you. In this Privacy Policy, "personal information" means information or opinion about an individual whose identity is apparent or can be reasonably ascertained from the information or opinion as further defined under applicable privacy laws.

This Privacy Policy does not apply to such third party websites, and Mexx is not responsible for the content of such third party websites or the privacy practices of such third parties. BY SUBMITTING PERSONAL INFORMATION TO MEXX OR ITS SERVICE PROVIDERS AND AGENTS, YOU AGREE THAT MEXX MAY COLLECT YOUR PERSONAL INFORMATION AND YOU CONSENT TO THE USE, DISCLOSURE AND TRANSFER OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW. Subject to legal and contractual requirements, you may refuse or withdraw your consent to certain of the identified purposes at any time by contacting Mexx at the address provided below. If you refuse or withdraw your consent, you acknowledge that Mexx may not be able to provide you or continue to provide you with certain services or information which may be of value to you.

Mexx reserves the right, in Mexx’s discretion, to change, modify, add or remove portions of this Privacy Policy at any time and from time to time, without prior notice to you. Mexx will treat your continued use of the Sites following such revision as your acceptance of the revised terms. However, if Mexx makes any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices. All revisions will be posted to the Sites and will apply to any personal information collected on or after the date posted. Mexx will obtain the necessary consents required under applicable privacy laws if it seeks to collect, use or disclose your personal information for purposes other than those to which consent has been obtained unless otherwise required or permitted by law.

Collection of Your Information

Mexx may collect personal information in connection with your use or purchase of Mexx’s products and services, including at the Stores, which may include information provided in connection with the following activities:

  • Registering or filling in forms on the Sites or in the Stores. This includes information you may provide when you request additional information about Mexx’s products and services or sign up to receive Mexx’s e-mail newsletters or coupons.
  • Completing a profile on the Sites.
  • Purchasing any product or service from Mexx, whether at a Store or on the Sites.
  • Providing design or product feedback or making other submissions to Mexx.
  • Requesting information or assistance from Mexx. Mexx may also keep a copy of any communications or correspondence you may send to it, including any e-mail communications.
  • Participating or responding to consumer survey or requests for consumer’s opinions, concerns, and preferences regarding Mexx’s products and services.
  • Participating in consumer contests, sweepstakes and other promotions.
  • Using other features of the Sites that may be offered from time to time, and may require such information in order to utilize the feature.

The personal information that Mexx may collect may include your name, username, password, email address, age, date of birth, gender, address, telephone number, credit card and debit card numbers (with expiration dates), personal preferences, and any other personal information that you choose to include in your profile, or in other communications to Mexx. You represent and warrant that you have the right and authority or have obtained all necessary consents to provide any information, including any personal information of another individual, which is provided by you to Mexx.

Mexx may also collect information that may not be personal information, which may include, but is not limited to, the frequency of user visits to the Sites, the routes by which users access the Sites and use of any hyperlinks available on the Sites. Mexx or its service providers and agents may process and use this aggregate data for various purposes including, but not limited to, analysis of this data for trends and statistics, development of the Sites and the Sites’ features and offerings, assessing patterns of use, or planning and evaluating marketing initiatives. This information is gathered by certain tools and methods such as the collection of your IP address or the use of cookies and is maintained, used and disclosed in aggregate form unless otherwise noted. We do not link this automatically-collected data to personal information.

Cookies and Other Tracking Technologies

Like many websites, Mexx utilizes “cookies” to maintain a record of your visit to the Sites. A cookie is a small text file that is transferred by a web server and stored on the hard drive of your computer. It can only be read by the server that sent it to you. This information does not identify you personally and you remain anonymous unless you have otherwise provided Mexx with personal information. We use both session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. We use session cookies to make it easier for you to navigate our website. A persistent cookie remains on your hard drive for an extended period of time. We set a persistent cookie to store your passwords, so you don’t have to enter it more than once. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.

Cookies help Mexx improve the Sites and to deliver more personalized service by enabling Mexx to estimate audience size and usage patterns; to store information about your preferences; to speed up your searches and to recognize you when you return to the Sites.

Most web browsers automatically accept cookies. If you would prefer to prevent your computer from accepting Mexx cookies, you may follow your Internet browser’s steps for doing so. Please note, however, that if you do disable cookies from your browser, you may not be able to access certain sections of the Sites.

  • Web Beacons / Gifs

Our third party advertising partner employs a software technology called clear gifs (a.k.a. Web Beacons/Web PixelsBugs) that help us better manage content on our Sites by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We tie [do not tie] the information gathered by clear gifs to our customers’ personal information.

  • 3rd Party Tracking

The use of cookies by our partners, affiliates, tracking utility company, and service providers, is covered by our privacy policy. We do have access or control over these cookies. Our partners, affiliates, tracking utility company, and service providers use session ID cookies and persistent cookies to make it easier for you to navigate our site, in order for you to use the shopping cart, etc.

  • Behavioral Targeting / Re-Targeting

We partner with a third party ad network to either display advertising on our Sites or to manage our advertising on other sites. Our ad network partner uses cookies and Web beacons to collect non-personal information about your activities on this and other websites to provide you targeted advertising based upon your interests. If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out by clicking Here. Please note this does not opt you out of being served advertising. You will continue to receive generic ads.

IP Addresses

An IP address is a computer's numeric address, by which it can be located within a network. Mexx may record your IP address when you visit or use services or features on the Sites. Mexx may use your IP address for the purposes noted above, and also to help diagnose problems with Mexx’s server, or to administer the Sites. Mexx may also use your IP address to identify you when Mexx feels it is necessary to enforce compliance with this Privacy Policy or the Terms of Use, or to protect the Sites, systems, information, employees, service providers, business partners, users, customers and others.

Protection of Your Information

To prevent unauthorized access or disclosure, maintain data accuracy and facilitate the appropriate use of information, Mexx uses physical, technological and administrative procedures to protect the personal information that Mexx collects from loss, unauthorised access, modification, disclosure or other misuse. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL).

Nevertheless, Internet transmissions are never completely private or secure. You understand that any messages or information you send to the Sites may be read or intercepted by others. Use of Your Personal information

Upon Mexx’s collection of your personal information, Mexx may use such personal information internally, separately or in combination with pre-existing information, for the following purposes:

  • To develop, enhance, market, sell or otherwise provide information, products or services;
  • To establish and conduct commercial relationships, including to process purchases or other transactions and to conduct or administer other transactions that you may engage in with Mexx including at the Stores, on or through the Sites;
  • To conduct or administer contests, sweepstakes or other promotions in which you have participated;
  • To contact you and to respond to any communications that you may have had with us;
  • To troubleshoot problems with the Sites;
  • To customize your experience or homepage on the Sites;
  • To develop and manage Mexx’s business and operations;
  • To enforce Mexx’s Terms of Use or comply with this Privacy Policy;
  • To detect and protect Mexx and other third parties against error, negligence, breach of contract, fraud, theft and other illegal activity, and to audit compliance with Mexx’s policies and contractual obligations;

Personal information collected by Mexx may be stored and processed in Canada, the United States and Netherlands. All personal information is stored on our partner's servers in the Netherlands at the following address:

Disclosure of Your Information

We will share your personal information with third parties only in the ways that are described in this privacy policy. We do not sell your personal information to third parties.

Mexx may disclose your personal information to its subsidiaries or affiliates and to third parties whom Mexx hires to provide services on Mexx’s behalf, including, but not limited to, support services, website services, delivering promotional materials, contests, sweepstakes and other promotions, and answering customer questions about Mexx’s products and services. These subsidiaries, affiliates and third parties may be located overseas. Mexx will only provide those third parties with the personal information that they need to deliver the services to Mexx and/or on Mexx’s behalf.

In the event that Mexx is involved in a business transaction, including the purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, securitization or financing involving Mexx, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information. You also consent to Mexx disclosing your personal information to legal, financial, insurance, or other advisors in connection with such business transaction or management of all or part of Mexx’s business or operations; as consented to by you from time to time, including to fulfill any other purposes that are identified when the personal information is collected; or as otherwise permitted or required by law.

Mexx may also disclosure your information as required by law, such as to comply with a subpoena, or similar legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

Retention of Your Personal information

The personal information that you provide will be retained by Mexx for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. However, Mexx will take reasonable steps to destroy or permanently de-identify personal information it holds if it is no longer needed for Mexx business purposes.

Children's Privacy

Mexx recognizes the privacy interests of children and Mexx encourages parents and guardians to take an active role in their children's online activities and interests. The Sites are not intended for children under the age of 13. Mexx does not target its services or the Sites to children under 13. Mexx does not knowingly collect personal information from children under the age of 13.

Choice and Opt-Out Preferences

Mexx does not collect your personal information unless you choose to provide it. If, at any time, you prefer not to receive further email communications from Mexx (except in connection with information, products or services that you specifically request), you will have the ability to unsubscribe from such communications by means of a link provided in every broadcast e-mail that is sent to you by Mexx.

We may provide you the opportunity to participate in contests or surveys on our website. If you participate, we will request certain personal information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as postal code).

We use this information to notify contest winners and award prizes, to monitor site traffic or personalize the website and/or to send participants an email newsletter.

We may use a third party service provider to conduct these surveys or contests; that company is prohibited from using our users’ personal information for any other purpose. We will not share the personal information you provide through a contest or survey with other third parties unless we give you prior notice and choice.

Access and Correction

Mexx will take reasonable steps to ensure the personal information it holds is accurate, complete and up to date. Upon your written request, subject to certain exceptions, Mexx will inform you of the existence, use and disclosure of your personal information and give you access to that information. Additionally, if you have any questions or enquiries relating to our privacy practices or procedures, or if you believe that the personal information that Mexx holds about you is not accurate, complete or up to date you may correct, update or delete your personal information by making the change on our member information page or you may write to the Privacy Officer at the address provided below. We will respond to your request to access within 30 days.

Collection and Use of 3rd Party Personal Information

You may also provide personal information about other people, such as their first and last name. This information is only used for the sole purpose of completing your request or for whatever reason it may have been provided.

Social Media Widgets

Our website includes Social Media Features, such as the Facebook and Twitter button or interactive mini-programs that run on our website. These Features may collect your IP address, which page you are visiting on our website, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our website. Your interactions with these Features are governed by the privacy policy of the company providing it.
